Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the records of the second respondent in ROC. No.54401/2005/F1, dated 21.04.2006 and to quash the same and consequently, to direct the respondents to give promotion to the post of Executive Engineer from the petitioner's date of eligibility after re-fixing the integrated seniority of Diploma Holder's and Degree Holders in accordance with service Rules made in G.O.(MS)No.309, dated 24.12.1997 by taking into consideration of the date of appointment in the post of Junior Engineer/Assistant Engineer.

O R D E R

The petitioner filed a writ petition challenging the rejection of his request to re-fixation of seniority of Assistant Executive Engineer who were temporarily promoted for the period of 05.12.1988 and 24.12.1997 respectively (i.e. with reference to the date of appointment).

2. In the absence of any interim order, the stay application already dismissed for non prosecution on 19.10.2006. Subsequently, the petitioner was given promotion as Executive Engineer and joined duty on 31.07.2010 onwards and thereafter, the petitioner was permitted to retired from service on 30.06.2015. The claim of the petitioner had already given by the respondents as per the Tamil Nadu Municipal Engineering Service Rules.

3. In view of the above nothing survives for adjudication in this writ petition. Accordingly, the Writ Petition is dismissed as infructuous. No costs.
