ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to 3rd respondent is dispensed with. 2.The present writ petition is filed praying for a Writ of Mandamus to direct respondents 1 and 2 to conduct Survey, Demarcation and Place boundary stones and to complete the process within a specified period in respect of the property comprised in S.No.188/68, measuring an extent of 0.72 ares situated at Sithapattinam Village, Vanapuram Taluk, Kallakuruchi District, and to dispose of the petitioner's application dated 23.05.2025 on merits and in accordance with law. 3.It is submitted by the learned counsel for the petitioner that petitioner is a resident of the subject property and an assignment order was issued by the 1st respondent vide proceedings H.S.No.50/2023 dated 2/6
25.08.2023 with specific boundaries. It is further submitted that petitioner applied for mutation of revenue records in her name in the year 2023 and the same was effected. Subsequently, patta was issued in petitioner's name for Natham S.No.188/68 vide Patta No.771 and further change of name was effected in "A" register also. 4.It is further submitted by the learned counsel for petitioner that petitioner submitted an application dated 23.05.2025 to the first respondent to conduct survey, demarcation and place boundary stones on the subject property and had paid necessary fees for the same. Since the petitioner's representation has not been considered by the respondents 1 and 2 till date, the present writ petition has been filed before this Court. 5.Learned Government Advocate for the respondents 1 & 2 would submit that they would consider the petitioner's application dated 23.05.2025 and conduct conduct survey, demarcation and place boundary stones on the subject property within a time frame to be fixed by this Court, which was agreed to by the learned counsel for the petitioner. 3/6
6.In view thereof, the writ petition stands disposed of with a direction to the respondents 1 and 2 to conduct survey, demarcation and place boundary stones on the subject property, after putting the petitioner, 3rd respondent, adjacent land owners and other interested party including rival claimants, if any on notice, within a period of 8 weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law.
