This Criminal Original Petition has been filed by the petitioners, who were arrested and remanded to judicial custody on 03.07.2024, seeking bail in Crime No.133 of 2024 for the alleged offences punishable under Sections 341, 307 & 506(ii) of IPC @ Sections 147,148, 341, 307, 506 (ii) r/w 34 of IPC.

2. Learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the petitioners are no way connected with the alleged offence and they have been in custody from 03.07.2024. He also submitted that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court, hence, he sought for bail.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police raised objection stating that, due to the previous enmity, the petitioners along with five other accused attacked the de facto complainant's husband and his brother, due to which, they sustained grievous injuries. He further submitted that the investigation in this case is not yet completed and the first petitioner is arrayed as A1, against whom 16 previous cases are pending and the Goondas proposal is also pending against him and as far as the second petitioner/A2 is concerned, 20 previous cases are pending against him. He also submitted that both the petitioners are habitual offenders, therefore, if they are released on bail, there is a possibility of them absconding and would also threaten the witnesses. https://www.mhc.tn.gov.in/judis

4. Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either side and taking note of the antecedents of the petitioners and also considering the gravity of the offence committed by the petitioners, this Court is not inclined to grant bail to the petitioners.
