ORDER

Review Petition has been instituted to review the order dated 02.11.2018 passed in W.P.No.28319 of 2013.

2. Learned Special Government Pleader would mainly contend that relief was granted to the writ petitioner in paragraph No.8. In Paragraph No.8(iii), this Court has passed an order stating that ""On receipt of such payment and application, the authorities competent are directed to consider the application submitted by the writ petitioner favourably for extending the scheme of rehabilitation of sick units to the writ petitioner also, within a period of four weeks from the date of deposit of the said amount of Rs.25,00,000/-". Once a direction was issued to consider the application, the word "favourably" would be an impediment for the authorities to consider the eligibility of the writ petitioners to avail the scheme of rehabilitation. Thus, it is to be treated as an error apparent.

3. This Court has passed an order directing the competent authority to consider the application on its own merits, and based on the eligibility criteria fixed to avail the benefits of the scheme of rehabilitation. Therefore, the word "favourably" in Paragraph No.8(iii) is deleted and read as "On receipt of such

payment and application, the authorities competent are directed to consider the application submitted by the writ petitioner for extending the scheme of rehabilitation of sick units to the writ petitioner also, within a period of four weeks from the date of deposit of the said amount of Rs.25,00,000/-". Accordingly, the review petitioner shall consider the application submitted by the writ petitioners for extending the scheme of rehabilitation on its own merits and by following the procedure. Thus, the review petition is allowed. No costs.
