ORDER

The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the respondents to survey the petitioner's property bearing Survey Nos. 9/2B and 9/3A, admeasuring 1 Hectare and 50.5 Ares (3 Acres and 71 Cents), situated in North Mettupalayam Village (Mettupalayam Vadapakkam Village), Veppanthattai Taluk, Perambalur District, in accordance with the due process of law and based on the petitioner's application bearing No. 2025/0123/16/005830.

2. The petitioner submits that in order to ascertain the correct boundaries of the subject property, he submitted an online application dated 30.07.2025 to the respondents requesting a survey. However, the said application has not been considered till date. Aggrieved by the inaction on the part of the respondents, the petitioner has been constrained to file the present Writ Petition.

3. Heard the learned counsel for the petitioner and Mrs.Inthu Karunakaran, learned Government Advocate for the respondents.

Considering the facts and circumstances of the case and the submissions made on either side, this Court directs the respondents 1 and 2 to consider the petitioner's online application dated 30.07.2025 and conduct survey of the subject property and fix boundary stones within a period of six (6) weeks from the date of receipt of a copy of this order. It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the jurisdictional Police, and the jurisdictional Police are mandated to provide necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in taking over possession after completing the survey to hand it over to any party. Such exercise shall be carried out exclusively through the competent Civil Court.

5. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
