2. Since the first respondent remained absent before the Tribunal and was set ex parte, issuance of notice to the first respondent is dispensed with.

3. Ms.C.Harini, learned counsel accepts notice for the second respondent. She did not raise any objection.

4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 4 days in filing the above appeal is condoned.

5. Registry is directed to number the main Civil Miscellaneous Appeal, if it is otherwise in order and list the same for admission in due course.

6. Registry is directed to print the name of Ms.C.Harini, learned counsel for second respondent at the time of admission.
