2022-08-29Honourable Mr Justice G.K. Ilanthiraiyan2 pages

Crl.M.P.No. 13413 of 2022 in Crl.O.P.No.16967 of 2022 G.K.ILANTHIRAIYAN, J.

This petition has been filed to modify the condition imposed on the petitioner by an order dated 02.08.2022 in Crl.O.P.No. 16967 of 2022 that the petitioner shall file an undertaking affidavit before the learned Magistrate concerned that he will not indulge in any similar offence any further.

2. Heard both sides.

3. This Court has granted anticipatory bail to the petitioner on 02.08.2022 in Crl.O.P.No. 16967 of 2022 on the following condition : "the petitioner shall file an undertaking affidavit before the learned Magistrate concerned that he will not indulge in any similar offence any further".

4. The learned counsel for the petitioner would submit that the direction issued by this Court to file an undertaking affidavit would amount to admitting of guilt. It is seen that the allegation against the petitioner is that he has spoken dishonour about the Lord Jesus. Mere filing of undertaking affidavit that he will not to indulge in any similar offence would amount to admitting of guilt.

5. In view of the above, this Court finds no reason to modify the condition imposed on the petitioner in Crl.O.P.No.16967 of 2022 dated 02.08.2022. Accordingly, this Criminal Miscellaneous Petition stands dismissed.
