This application has been filed at the stage when there is a proposal to examine D.W.2. The application has been filed for marking additional document, which is ''statement of accounts''.

2. Learned counsel for the plaintiff opposes to the same and submits that the document may be marked subject to proof and relevancy and that the objection of the plaintiff may be recorded to the effect to deny the content of the same.

3. I have considered the arguments advanced by the learned counsel for the plaintiff and learned counsel for the defendant.

4. This Court is inclined to allow the application. Accordingly, this application is allowed to receive the documents as evidence. However, the marking of the document will be subject to admissibility, proof and relevancy, all other objections that are available under law. All other objections which are Page No.1/3
