ORDER

This contempt petition has been filed praying to punish the respondents for the wilful disobedience of the orders of this Court made in Crl.O.P.No.1929 of 2024 dated 09.02.2024.

2. When the matter was taken up for hearing today, Ms.K.Rohini, Inspector of Police (Crime), Pallavaram Police Station, Chennai, was present in person along with the CD file. An affidavit was also filed. The relevant portions in the affidavit are extracted hereunder:

5. I respectfully submitted that after took up the investigation, the then Inspector of Police have examined the defacto complainant and other victims and recorded their u/s.161 Cr.P.C statements.

7. I respectfully submitted that then Inspector of Police conduct enquiry and record statements of 21 victims. I joined this Police Station on 12.12.2024. During investigation I came to know since the offence involved is in TNPID Act and expected more number of victims.

I respectfully submitted that on 08.07.2025, I had sent requisition letter to the Commissioner of Police, Tambaram City Police, Chennai to transfer the above case in Cr.No.94/2024, U/s.406, 420 IPC r/w.5 of TNPID Act, 1997 to the Economic Offences Wing, Chennai and the same was sent by the Commissioner of Police, Tambaram City to the Director General of Police, Chennai, the Director General of Police, Chennai has issued Memorandum vide Ref.No.11195338/Crime - 1(1)/2025 dated 05.08.2025, said that the total cheated amount involved in the above said case and the proposal to transfer the case does not meet the requirements of the Circular Memorandum in Rc.No.00710/Cr 2(1)/2025, dt. 07.07.2025. having monetary value of 3 Crores and above are to be handled by EOW."

3. This Court also went through the CD file wherein it is seen that Section 161 Cr.P.C. statements of 21 victims have been recorded and it has been ascertained that a total sum of Rs.21,14,750/- has been collected from the depositors and it was not repaid.

The investigating officer present before this Court stated that after recording of the Section 161 Cr.P.C. statements, a request was made to the Commissioner of Police for transferring the investigation to the Economic Offences Wing, Chennai. However, it was not transferred on the ground that it does not satisfy the requirement under the Memorandum dated 05.08.2025 which requires a minimum value of Rs.3 crores in order to transfer the case to the Economic Offences Wing.

5. The investigating officer stated that the investigation is almost complete and that the police report will be filed before the concerned Court within a period of four (4) weeks from the date of receipt of a copy of this order.
