This Court while granting anticipatory bail to the petitioner in Crl.O.P.No.10741 of 2022, by an order dated 20.05.2022, imposed one of the conditions that the petitioner shall deposit a sum of Rs.10,00,000/- (Rupees ten lakhs only) to the credit of Crime No.4085 of 2020. Since the said condition was not complied with, this Court cancelled the anticipatory bail granted to the petitioner in Crl.M.P.No.13472 of 2022 by an order dated 12.10.2022. 2.

Aggrieved by the above orders, the petitioner approached the Hon'ble Supreme Court of India in Special Leave Petition (Criminal) D.No.38134 of 2022 and the Hon'ble Supreme Court of India by an order dated 09.02.2023, restore the bail application to the Board of this Court for fresh consideration.

The learned counsel appearing for the petitioner submitted that the petitioner had already returned a sum of Rs.5,50,000/- (Rupess five lakhs fifty

thousand only) to the defacto complainant. Further he is ready and willing to return a sum of Rs.2,50,000/- (Rupees two lakhs fifty thousand only) to the defacto complainant within a week.

Considering the above submission, the petitioner is directed to return a sum of Rs.2,50,000/- (Rupees two lakhs fifty thousand only) directly to the defacto complainant and produce the acknowledgment given by the defacto complainant before this Court on 20.03.2024.
