ORDER

This criminal original petition has been filed praying to quash the proceedings in STC No.2197 of 2021 pending on the file of the Judicial Magistrate, Mannargudi.

On perusal of records, it is revealed that the petitioner is

arrayed as accused in the complaint lodged by the respondent in STC No.2197 of 2021 pending on the file of the Judicial Magistrate, Mannargudi for the offence punishable under Section 138 of NI Act. Further, the petitioner was absent before the trial court and as such, bailable warrant is pending against the petitioner. When the bailable warrant is pending, this criminal original petition cannot be entertained and on this sole ground, this criminal original petition is liable to be dismissed.
