JUDGMENT

(Judgment of the Court was delivered by S.M.Subramaniam J.) The writ order dated 25.04.2022 in W.P.No.19820 of 2010 is under challenge in the present writ proceeding.

2. Writ Petitioner is the appellant. Appellant was holding the post of Assistant in the respondent Corporation.

The contention of the appellant is that without properly fixing the interse seniority list between the employees working in two wings of the employees Corporation, the promotion to the appellant was denied. His juniors were promoted to the post of Senior assistant in the year 1992. Thus, the appellant made a representation and thereafter, filed writ petition W.P.No.15769 of 1996.

4. This Court directed the authority to grant promotion to the petitioner to the post of Senior Assistant in accordance with the seniority. Admittedly, such promotion was granted to the appellant on par with his juniors notionally with effect from the date on which his juniors were promoted as Senior Assistants, but the actual monetary benefit was extended from the date of joining the promotional post.

Not satisfied with the relief granted by this Court as well as the authority, the appellant filed Writ petition claiming monetary benefits from the date of which he was notionally promoted in the promotional post of Senior Assistant. Writ Court elaborately considered the facts as well as the legal principles and held that appellant has not served in the promotional post. Therefore, he is not entitled for actual monetary benefits. That apart, notional promotion was granted to the appellant in the promotional post from the date on which, his immediate junior was promoted along with seniority and other consequential service except the actual monetary benefits. That being the factum, this Court does not find any infirmity in respect of the writ order impugned.

6. Accordingly, the writ appeal stands dismissed. No costs. Consequently, the connected miscellaneous petitions, if any, are closed. (S.M.S.,J.) (N.S.,J.) 03-06-2026 Index: Yes/No Speaking/Non-speaking order GD
