O R D E R

The respondent in H.M.O.P.No. 197 of 2015 on the file of Subordinate Court, Tiruppur is the petitioner in this transfer petition.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondent.

3. The proceedings in H.M.O.P.No. 197 of 2015 was instituted by the respondent against the petitioner praying for a decree of divorce. The matter is now pending on the file of Subordinate Court, Tiruppur.

According to the petitioner, she is a resident of Chettipalayam, Podanur, Coimbatore. She has to travel about 70 kms for attending the Court at Tiruppur. The petitioner has to look after her three years old son and as such, it would not be https://hcservices.ecourts.gov.in/hcservices/

possible for her to appear before the Court at Tiruppur regularly. There is nothing on record to disbelieve the case pleaded by the petitioner.

In fact, the learned counsel for the respondent has no objection for transfering the proceedings.

6. In the result, the proceedings in H.M.O.P.No. 197 of 2015 is withdrawn from the file of Subordinate Court, Tiruppur, and is transferred to the file of Family Court, Coimbatore, for disposal on merits.

7. The Transfer Civil Miscellaneous Petition is allowed as indicated above.

No costs.

Consequently, connected Miscellaneous Petition is closed.
