ORDER

This Criminal Original Petition has been filed seeking a direction to the Special Judge for Exclusive Trial of Cases registered under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Villupurm to accept the surrender of the petitioner in connection with Crime No.252 of 2026 on the file of the 2nd Respondent Police and consider the bail application of the petitioner on merits and in accordance with law and dispose of the same on the very same day of surrender.

2. It is seen that the defacto complainant has to pass through the petitioner's land to reach his agriculture field. The petitioner had tied a cow on the way. The same was untied and tied at a different place. Thereafter, when the defacto complainant's father went to the field, the petitioner assaulted and abused him by using his caste name.

3.Heard the learned Additional Public Prosecutor for respondents 1 and 2 and perused the materials on record.

4.In view of the above factual position, there shall be a direction to the Special Judge for Exclusive Trial of Cases registered under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Villupurm, to

consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Crime No.252 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioner shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
