O R D E R

This Criminal Original Petition has been filed seeking a direction to the 1st respondent not to harass the petitioner in connection with the complaint pending against him in C.S.R. No. 319 of 2026.

2. It is seen that, on the complaint lodged by the 2nd respondent, C.S.R.No.319 of 2026 was registered and the petitioner was called for enquiry. Though a summons was issued to the petitioner on 10.06.2026, he failed to appear before the respondent police and has now projected the enquiry as an act of harassment.

3. The contention of the petitioner is that a case under Section 138 of NI Act is pending between the petitioner and the 2nd respondent. Suppressing the pendency of the said case, the 2nd respondent has lodged the false complaint.

4. The learned counsel for the petitioner, on instructions, submitted that the petitioner undertakes to appear before the 1st respondent, produce all the relevant materials and give his explanation. 2/4

5. In view of the above, the 1st respondent is directed to issue a fresh summons to the petitioner for his appearance. On receipt of the same, the petitioner shall appear before the 1st respondent, produce all the relevant materials and give his explanation. The enquiry shall be completed within a period of two months from the date of receipt of a copy of this order. It is made clear that, under the guise of enquiry, the petitioner shall not be subjected to any harassment.

6. With the above directions, this Criminal Original Petition is disposed of.
