(Judgment of the Court was delivered by V.M.VELUMANI,J.) The appellant/husband filed O.P.No.812 of 2017 (earlier F.C.O.P.No.58 of 2014 on the file of the Family Court-cum-V Additional 1/4

District Court, Tirpathi) on the file of the Principal Family Court, Chennai, for dissolution of marriage conducted between the appellant and respondent on 20.08.2012. The respondent/wife filed I.A.No.1 of 2021 in O.P.No.812 of 2017 on the file of Principal Family Court, Chennai, for a direction to the appellant to pay a sum of Rs.25,000/- per month as interim maintenance and Rs.2,65,000/- towards litigation expenses. The learned Judge, by order dated 14.07.2022 made in I.A.No.1 of 2021 in O.P.No.812 of 2017, directed the appellant/husband to pay a sum of Rs.25,000/- per month towards interim maintenance from the date of I.A. till the disposal of main O.P. and Rs.1,50,000/- towards litigation expenses. Challenging the said order and decree, the appellant/husband has come out with the present appeal.

2.When the appeal is taken up for hearing today, both the appellant and respondent appeared before this Court. They were identified by their respective counsel. The learned counsel appearing for the appellant and respondent along with the parties represented that the parties have arrived at the settlement and are filing a Joint Memo of Compromise dated 02.11.2022, duly signed by both the appellant as well as respondent and 2/4

their respective counsel and prayed for passing of decree of divorce by mutual consent.

3.The Joint Memo of Compromise dated 02.11.2022, duly signed by both the appellant as well as respondent and their respective counsel is taken on file and the same is recorded. Recording the Joint Memo of Compromise and the submissions of the learned counsel appearing for the appellant as well as the respondent, the Civil Miscellaneous Appeal is disposed of by granting decree of divorce by mutual consent in terms of joint memo of compromise. The Joint Memo of Compromise dated 02.11.2022 shall form part of the decree. Consequently, connected Miscellaneous Petition is closed. No costs.
