The petitioner, who apprehends arrest for the alleged offence under Sections 4(1)(aaa), 4(1)(h), 4(1-A)(ii) of Tamil Nadu Prohibition Act in Crime No.307 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. There are totally two accused in this case, in which the petitioner is arrayed as A2. The case of the prosecution is that the petitioner along with other accused were found in illegal possession of 2496 packets of XXX Rum (each packet containing 90 ml). Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He would further submit that only based on the confession statement of A1, the petitioner was implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

Anu 4.The learned Additional Public Prosecutor appearing for the respondent submitted that there are three previous cases pending as against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the previous cases pending as against the petitioner, this Court finds that the custodial interrogation of the petitioner is very much required. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
