Petition filed under Section 24 of the Civil Procedure Code seeking to withdraw the I.D.O.P.No.71 of 2015 on the file of the Principal District Judge, Tiruvallur and transfer the same to the file of the Principal Family Court at Chennai.

O R D E R

The respondent filed the proceedings in I.D.O.P.No.71 of 2015 before the learned Principal District Judge, Tiruvallur. The prayer in this petition is to transfer the proceedings to the Principal Family Court at Chennai.

2.Heard the learned counsel for the petitioner and the learned counsel for the respondent.

3.The respondent initiated a matrimonial proceedings against the petitioner in I.D.O.P.No.71 of 2015 before the learned Principal District Judge, Tiruvallur. The petitioner on receipt of summons filed this petition for transfer.

4.The petitioner is stated to be a resident of Chennai. She is employed at Chennai. The respondent is residing at Pattabiram, Chennai.

5.When the matter was taken up for consideration, the learned counsel for the petitioner and the learned counsel for the respondent agreed for transfer of the proceedings to the District Court at Chengalpet. In view of the consensus arrived at among the parties, there is no need for a factual adjudication of the issue raised in this transfer petition.

6.In the result, the proceedings in I.D.O.P.No.71 of 2015 is withdrawn from the file of the Principal District Court, Tiruvallur and is

transferred to the file of the District Court at Chengalpet for disposal on merits.

7.The transfer petition is disposed of with the above direction. No costs. Consequently, the connected miscellaneous petition is closed.
