Writ Petition filed under Article 226 of the Constitution of India praying to issue a writ of mandamus directing the respondents to remove the encroachments made by fourth respondent in Survey No.453/47" in and around the 440 w Electric Transformer put up by the Tamil Nadu Generation and Distribution Corporation,in Tirur Village, Tiruvallur District and land belong to the Tirur Panchayat to extent of 3*38 sq.ft in northern side of his land.

ORDER
[Order of the Court was made by M.SUNDAR, J.] After some arguments, Mr.T.Dharani, learned counsel sought leave of this Court to withdraw the captioned 'Writ Petition' ['WP' for the sake of brevity] but made a prayer to preserve the rights and contentions of writ petitioner to come to this Court again by mentioning the correct survey number and location of the alleged encroachment.
2. To be noted, writ petitioner talks about encroachment in Survey No.453/47 and it talks about encroachment around a transformer but there is no document to demonstrate the revenue classification of Survey No.453/47. Relying on a photograph, learned counsel submitted that it is an electric pole and not a transformer. These are the circumstances under which the request for withdrawal is made by learned counsel for writ petitioner. In the light of the narrative thus, captioned writ petition is dismissed as withdrawn with preservation of rights to come to this Court giving the correct survey number and description, if so advised and if so desired. There shall be no order as to costs.
