ORDER

This contempt petition has been filed to punish the respondents herein for contempt of Court for wilful and deliberate disobedience of undertaking given before the Hon'ble High Court as per the order dated 08.04.2022 in O.P.No.737 of 2021.

2.This Court by its order dated 12.10.2023 directed the first respondent/wife to handover the custody of the minor child to the petitioner/husband and the petitioner/husband shall retain the custody of the child till this morning i.e.16.10.2023. As per order of this Court, the child was with his father/petitioner till this morning. In this regard, the petitioner/husband filed an affidavit dated 16.10.2023 stating that the child was very comfortable with him and they spent quality time together. The child was very happy with him and his mother also. Recording the same, the contempt petition is closed for the present and both the petitioner as well as the respondents are directed to duly comply with the order of this Court based on the joint compromise memo. If this Court finds any deviation, at any time suo motu contempt proceedings will be initiated.
