This petition is filed under Section 378 (4) Cr.P.C, to grant special leave to prefer an appeal against the judgment dated 26.05.2023 made in C.C.No.375 of 2018 on the file of the Judicial Magistrate, Mettupalayam.

2. Heard Mr.C.Ramkumar, learned counsel for the petitioner.

3. Learned counsel for the petitioner contended that though the accused admitted his signature on the impugned cheque, the trial Court acquitted the accused on the ground that the complainant had not proved his source of income to lend the amount to the accused.

4. According to the learned counsel for the petitioner, there are arguable points in the main appeal and therefore, special leave is granted as prayed for.
