ORDER
This writ petition has been filed challenging the impugned communication dated 05.12.2018 issued by the 2 nd respondent and for a consequential direction to the 2 nd respondent to issue fresh passport to the petitioner.
2. The learned Government Advocate appearing on behalf of the 1 st respondent submitted that the criminal case is pending against the petitioner in CC.No.247 of 2018 on the file of the Judicial Magistrate No.IV, Coimbatore (later, transferred to Judicial Magistrate No.II, Coimbatore and renumbered as CC.No.349 of 2021).
3. The 2 nd respondent has issued communication dated 05.12.2018 to the petitioner based on the adverse police verification report received from the 1 st respondent. For reasons best known to the petitioner, the communication that was received in the year 2018 was kept under the carpet and after a deep hibernation, the petitioner has suddenly approached this Court in the year 2025. Therefore, no useful purpose will be served by interfering with the impugned communication dated 05.12.2018.
4. Considering the fact that a criminal case is pending against the petitioner before the Judicial Magistrate No.II, Coimbatore in CC.No.349 of 2021, there shall be a direction to the petitioner to submit a fresh application before the 2 nd respondent seeking for issuance of passport. On receipt of the same, the 2 nd respondent shall process the application and issue the passport in the name of the petitioner, if the petitioner satisfies all the requirements. Ultimately, if the petitioner wants to leave the Country, he has to necessarily get the permission of the concerned Court.
5. This writ petition stands disposed of in the above terms. No cost. Consequently, the connected miscellaneous petitions, if any, are closed. 23-07-2025 gd Index:Yes/No Speaking/Non-speaking order Internet:Yes
