..Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Habeas Corpus directing the respondents to produce the petitioner's missing son, namely, Gokulkannan, aged about 13 years, before this Court and set him at liberty.

ORDER

[Order of the Court was made by S. BASKARAN, J. ] The petitioner, who is the father of the detenu, has come forward with this Habeas Corpus Petition, seeking a direction to the respondents to produce his minor son, namely, Gokulkannan, who was missing from 8.10.2016.

2. The petitioner has stated that his minor son, namely, Gokulkannan, who is studying IX Standard in Cluny Matriculation School, Venkatesapuram, Katpadi, was missing on 8.10.2016 and he had lodged a complaint before the second respondent and the same was registered in Cr.No.520 of 2016.

3. On 17.10.2016, another complaint was given by the petitioner to the first respondent.

respondents have not taken any effective steps to trace his minor son, he has come forward with this petition.

4. Today, when the matter was taken up for hearing, the second respondent police had produced the detenu before this Court. The petitioner and his counsel are also present.

5. On enquiry, the detenu had stated that as he had done the exams with poor performance, he had left his house on his own and now he has expressed his willingness to go along with the petitioner, who is his father. The petitioner has also agreed to take him back to his house and assured to take care of him.

6. In such circumstances, the detenu is permitted to go along with the petitioner, who is his father.
