ORDER

The petitioner apprehends arrest for the alleged offence under Sections 296(b), 115(2) and 109 of BNS 2023 in Crime No.63 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with another accused attacked the de facto complainant with knife. Hence, the case.

3. The learned counsel for the petitioner submitted that there are about two accused and this petitioner is arrayed as A1. He further submitted that A2 has already been released on bail. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has got five previous cases including Women Harassment and Hurt cases and is a history sheeter. Hence, she opposed to grant anticipatory bail to the petitioner.

5. I have given my anxious consideration to either side submissions and perused the materials available on record.

6. Considering the facts and circumstances of the case, taking note of the submissions made by the learned counsel on both sides, though the learned counsel for the petitioner submitted that in some of the cases, the petitioner was

acquitted, the fact remains that the petitioner is still accused in some other pending cases. In such circumstances, it is amply clear that the petitioner is prone to recidivism. As rightly contended if the petitioner is enlarged on bail, there is every possibility of him committing similar offences and it would become a threat to the society. In such a case, if anticipatory bail is granted, it would shock the conscience of the society. Hence, this Court is not inclined to grant anticiapatory bail to the petitioner.
