W.M.P.No.21351 of 2022 in W.P.No.16102 of 2022 C.V.KARTHIKEYAN,J.

The petitioner in W.P.No.16102 of 2022 is the mother and the 2nd petitioner in W.P.No.26132 of 2022 is her son. The 1st petitioner is his wife / daughter-in-law of the petitioner in W.P.No.16102 of 2022. The mother had executed originally a settlement deed in favour of the son. 2.Complaining that there has been violation of the terms of the settlement, the mother had approached the Revenue Divisional Officer seeking cancellation of the settlement deed.

3.In the meanwhile, on the basis of the settlement deed and on the basis of the relationship, the 1st petitioner S.Meena wife of the son / daughter-in-law had mortgaged the property with the Indian Bank, Kottai Main Road, at Salem. 4.The settlement deed was cancelled by an order of the Revenue Divisional Officer and the District Collector. Challenging that W.P.No. 26132 of 2022 had been filed. Since the settlement deed had been cancelled, the mother had filed W.P.No.16102 of 2022 stating that, if the balance amount under the mortgage https://www.mhc.tn.gov.in/judis had been paid, she must get back the title deeds.

smv 5.In W.P.No.16102 of 2022, W.M.P.No.21351 of 2022 had been filed to implead the son and daughter-in-law, since they are required to address the issues and particular since they have also questioned the order cancelling the settlement deed. The Writ Miscellaneous Petition is allowed. 6.The Registry is directed to carry out necessary amendment in the cause title in W.P.No.16102 of 2022.
