ORDER

This writ petition has been filed challenging the enquiry notice served on the petitioner by the first respondent dated 05.10.2021.

2.Heard Mr.K.Selvaraj, learned counsel appearing for the petitioner and Mr.Yogesh Kannadasan, learned Special Government Pleader appearing for the first respondent.

3.On perusal of the enquiry notice revealed that the second respondent lodged a complaint before the Inspector of Police, Magudanchavadi police station, dated 22.09.2021 and alleged that there is a dispute in respect of the common pathway between two groups.

4.Immediately, the said complaint was referred before the first respondent and on receipt of the same, the first respondent issued an impugned notice to conduct a peace committee meeting to be held on 07.10.2021. Though, the petitioner challenged the enquiry notice in this writ petition, the petitioner attended the enquiry on 07.10.2021 and requested for the alleged complaint and other details and the enquiry is pending.

5.Considering the above, the first respondent is directed to issue fresh notice to the petitioner and the other counter parties if any including the second respondent within a period of two weeks from the date of receipt of a copy of this order. The first respondent is also directed to furnish the alleged complaint lodged by the second respondent and other documents which was filed along with the complaint to the petitioner, so that the petitioner can file his reply to the complaint. 6.On receipt of the reply from the petitioner, the first respondent is directed to conduct an enquiry, after giving them an opportunity of hearing to the petitioner and the counter parties and pass orders on merits and in accordance with law within a period of twelve weeks thereafter.

7.With the above directions, this writ petition is disposed of. Consequently, connected Miscellaneous petitions are closed. There shall be no order as to costs. Sd/- Assistant Registrar(CS-VI) //True Copy// Sub Assistant Registrar Mn To
