O R D E R
(The case has been heard through video conference) The petitioner was arrayed as 1st accused and totally, there are two accused in the present case. The petitioner was arrested and remanded to judicial custody on 11.11.2020 for the offence punishable under Sections 294(b), 384, 392, 506(i) of I.P.C., subsequently altered into 294(b), 384, 392, 506(i) of I.P.C. and Section 25(1A) of Arms Act and now he has filed this petition seeking for bail.
2. The case of the prosecution is that the petitioner along with other accused threatened the defacto complainant to give a sum of Rs.35 lakhs and he has received a sum of Rs.10 lakhs. Hence, the complaint has been given.
3. The learned counsel appearing for petitioner would submit that a false complaint has been given against the petitioner alleging that he has received money by coercive manner and threatened the defacto complainant with dire consequences, that too after lapse of 8 months. The learned counsel would further submit that the petitioner has not possessed any gun and the respondent police foisted a false case as if the petitioner was in possession air gun. Hence, he prays to grant bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that the petitioner is an habitual offender and having so many cases for similar offence. Hence, she has opposed to grant bail. 5.Taking into consideration of the fact that the petitioner is an habitual offender and the offence is very serious in nature, this Court is not inclined to grant bail to the petitioner.
