J U D G M E N T

(delivered by K.K. SASIDHARAN,J.) The appellant has filed the intra court appeal challenging the judgment and decree, dated 20 October 2009 in C.S.No.970 of 2000.

2. During the currency of the intra court appeal, the parties have settled the matter, in and by which, the appellant has agreed to pay a total sum of Rs.39,00,000/- (Rupees Thirty Nine lakhs only) to the respondents 6 to 8, which is inclusive of the amount in Court Deposit (Rs.25,00,000/-). Both the parties appeared before us and confirmed the factum of settlement.

3. The parties have filed a Memorandum of Compromise, dated 10 January 2017 indicating the terms and conditions of the settlement. As per the settlement, the appellant has handed over Demand Drafts for a total sum of Rs.14,00,000/- to the respondents 6 to 8.

4. In view of the settlement arrived at among the parties, we permit the respondents 6 to 8 to withdraw the amount of Rs.25,00,000/-, which is lying in Court deposit.

5. The Original Side Appeal is disposed of in terms of the Memorandum of Compromise. The Memorandum of Compromise, dated 10 January 2017 shall form part of the decree. No costs.
