ORDER

This writ petition has been filed for issue of writ of mandamus directing the 2nd respondent to deal with the representation made by the petitioner on 28.01.2025, wherein, the petitioner is seeking for cancellation of the Class II Legal Heir Certificate issued by the 3rd respondent dated 26.09.2024.

3/6 2.Heard Mr.S.Petchiappan, learned counsel appearing on behalf of the petitioner and Mr.R.Neelakandan, learned Additional Advocate General appearing on behalf of the respondents 1 to 3. 3.The grievance of the petitioner is that a legal heirship certificate has been issued in favour of the 4th respondent by the 3rd respondent and aggrieved by the same, a representation was made before the 2nd respondent to cancel the legal heirship certificate on the ground that the petitioner is a Class I Legal Heir and that the 4 th respondent is only a Class II Legal Heir.

4.In the considered view of this Court, the power of cancellation is now available even to the Tahsildar and therefore, it is left open to the petitioner to submit a fresh application to the Tahsildar and on receipt of the same, the Tahsildar shall conduct an enquiry and take a decision after affording an opportunity to the petitioner and the 4th respondent, within a

4/6 period of eight weeks from the date of receipt of copy the fresh application from the petitioner.

5.This writ petition is disposed of with the above directions. No Costs.
