This Petition filed under Section 24 of C.P.C. praying to withdraw H.M.O.P.No. 1956 of 2016 on the file of Principal Family Court, Chennai and transfer the same to the file of Sub Court, Tiruttani.

O R D E R

The respondent in H.M.O.P.No. 1956 of 2016 on the file of Principal Family Court, Chennai, is the petitioner in this Transfer Petition.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondent.

3. The respondent instituted proceedings in H.M.O.P.No. 1956 of 2016 praying for a decree of divorce. The petitioner, being a resident of Tiruttani, has come up with the transfer petition on account of the difficulty to appear before the Court at Chennai.

The learned counsel for the respondent fairly submitted that the respondent has no objection in transferring the proceedings to a Court at Tiruttani.

The petitioner has demonstrated that it would be difficult for her to appear before the Court at Chennai for the purpose of defending the proceedings in H.M.O.P.No. 1956 of 2016.

Now that the respondent has also agreed to transfer the matter, necessarily the proceedings required to be transferred. 7.

In the result, the proceedings in H.M.O.P.No. 1956 of 2016 is withdrawn from the file of Principal Family Court, Chennai and is transferred to the file of Sub Court, Tiruttani, for disposal on merits.

The Transfer Civil Miscellaneous Petition is allowed as indicated above.

No costs.

Consequently, connected Miscellaneous Petition is closed.
