ORDER

The petitioner apprehends arrest for the alleged offence under Sections 296(b), 127(2), 115(2), 351(2) of BNS (294, 342, 323, 506 of Indian Penal Code, 1860) in Crime No.249 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The prosecution's case is that on 01.06.2026, the respondent police received an assault intimation from a person named Surendiran. He stated that

he had given a hand loan of Rs. 2 lakhs to Senthil. Despite repeated demands, the accused failed to repay the amount. On 29.05.2026, when the complainant sought repayment, the accused allegedly abused, assaulted and threatened him with dire consequences.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the defacto complainant and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and submitted that the petitioner has got four previous cases. Hence, he opposed the grant of anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. Considering the facts and circumstances of the case and taking note of the submissions made by the learned Government Advocate (Criminal Side)

that the petitioner has four previous cases, this Court is of the view that if the petitioner is released on bail, there is a possibility of recidivism. Hence, considering the larger interest of society, this Court is not inclined to grant anticipatory bail to the petitioner.
