..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the 2nd respondent to deposit the compensation amount by computing at the rate of Rs.900 per sq. ft. for one fourth share in survey number 33/1, Singanallur village, Coimbatore taluk, Coimbatore district to an extent of 29.25 cents (1183.71) sq.mts/ 12,741.3 sq.ft) and deposit the same to the credit of L.A.O.P No. 250 of 2025 on the file of Principal District Court, Coimbatore.

ORDER

This writ petition has been filed to direct the second respondent to deposit the compensation amount at the rate of Rs.900/- sq.ft., for the petitioner's 1/4th share in S.No.33/1 in Singanallur Village, Coimbatore to an extent of 29.25 cents and deposit the same to the credit of L.A.O.P.No.250 of 2025, on the file of Principal District Court, Coimbatore.

Learned counsel for the petitioner would submit that the other coowners of the S.No.33/1 have already executed a sale deed by way of private negotiation dated 10.02.2022 and 18.03.2022 respectively, wherein the sale deed was executed at the rate of Rs.900/- per sq.ft., and the compensation was also paid to the respective owners for 3/4th share. When the petitioner also sought for the said compensation at the rate of Rs.900/- per sq.ft., in respect of his 1/4th share, the same has not been agreed, citing the pendency of parition suit between the petitioner and other co-owners. Hence, the petitioner has come forward with the present writ petition.

3. Mr.B.Pachaiyappan, learned Government's Counsel, takes notice on

behalf of respondents 1 to 3 and fairly submitted that as the other co-owners have received compensation at the rate of Rs. 900/- per sq. ft. by way of private negotiation for their 3/4th share in S.No. 33/1, there will be no impediment on the part of the respondents to deposit the same to the petitioner for his 1/4th share in the aforementioned survey number.

4. Heard the learned counsel on either side and perused the materials available on record.

In the case on hand, there is no dispute on the aspect that there was a private negotiation dated 10.02.2022 and 18.03.2022 respectively, wherein the sale deed was executed at the rate of Rs.900/- per sq.ft., and the same was paid to the other co-owners, who entitled for 3/4th share in S.No.33/1. Such being the case, the respondents have rejected the petitioner's claim for the said compensation, citing the pending partition suit. However, the said partition suit was dismissed before the Court below as not pressed. Hence, this Court does not find any impediment on the part of the respondents to deposit the said compensation at the rate of Rs.900/- per sq.ft., to the petitioner for his 1/4th share in S.No.33/1.

6. In view of the above, this Court directs the second respondent to deposit the compensation amount by computing at the rate of Rs.900 per sq.ft.,

for petitioner's 1/4th share in S.No.33/1, Singanallur Village, Coimbatore Taluk, Coimbatore District to an extent of 29.25 cents and deposit the same to the credit of L.A.O.P.No.250 of 2025 on the file of Principal District Court, Coimbatore. In the event the respondents requires any clarification, they are at liberty to issue notice to the parties concerned and conduct an enquiry and thereafter deposit the petitioner's compensation amount. The aforesaid exercise shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order.

7. With the aforesaid observation and direction, this writ petition stands disposed of. No costs.
