ORDER

The petitioner apprehends arrest for the alleged offences under Sections 316 (2), 318 (4) of BNS, in Crime No.167 of 2026 on the file of the respondent police seeks anticipatory bail.

2.The case of the prosecution is that the petitioner is the Managing Director of Royal Training and Testing Centre. It is alleged that the petitioner

along with other accused persons, induced the defacto-complainant to pay a sum of Rs.3,50,000/- on the pretext of securing foreign employment. Believing the petitioner's assurances, the defacto-complainant sent Rs.3,50,000/- and his original passport to him. However, the petitioner failed to arrange the job as promised. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and that he is ready to cooperate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.

4.Mr.V.Johnson Yuvaraj, the learned counsel for the intervenor submitted that the petitioner along with other accused persons cheated the defactocomplainant to the tune of Rs.3,50,000/- on the pretext of securing foreign employment. He further submitted that approximately 203 victims were cheated, one of whom, namely Iyygara Velan died on 07.08.2025 because the accused neither arranged a job nor returned the cheated amount. Hence, he opposed for grant of anticipatory bail to the petitioner.

5.The learned Government Advocate (Criminal Side) appearing for the respondent Police submitted that this is a case of job racketeering involving approximately 203 victims. He further submitted that the total amount cheated by the petitioner is approximately Rs.1,48,00,000/- and that the investigation is still pending. Hence, he strongly opposed the grant of anticipatory bail to the petitioner.

6.Considering the gravity of offence, and the fact that the investigation is still under progress, this Court is of the firm view that this is not a fit case to enlarge the petitioner on anticipatory bail. Accordingly, this Criminal Original petition is dismissed.
