A.No.3782 of 2021 in C.S.D.No.94357 of 2021 V.PARTHIBAN,J.

This application has been filed by the applicant/plaintiff seeking leave of this Court to institute the above civil suit against the 1st, 2nd, 3rd and 4th defendants.

2. The suit has been filed by the applicant/plaintiff to pass an order of permanent injunction restraining the defendant Nos.1 & 4 from usurping the voting rights of the defendant No.2 and interfering with the EGM of the plaintiff proposed to be held on 23.10.2021, in any manner whatsoever and for other consequential reliefs.

3. According to the learned counsel for the applicant/plaintiff that the suit has been filed seeking permanent injunction restraining the defendant Nos.1 & 4. Even though the cause of action is well within this jurisdiction of this Court, but the defendants 1, 2, 3 & 4 are living outside the jurisdiction of this Court and hence, this leave application is filed.

4. Considering the submission made by the learned counsel for the plaintiff/applicant and considering the averments made in this application as well as the plaint, leave is granted. 22.10.2021 gsk NOTE : Registry is directed to number the suit and post the same for hearing on 25.10.2021.
