The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 323, 324 and 506(ii) of IPC in Crime No.162 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 14.05.2023 at about 6.30 p.m, while the defacto complainant viz., Anand and his brother viz., Prashanth were playing cricket, the petitioner and other accused quarrelled with each other and at that time, the defacto complainant and his brother tried to pacify the quarrel, for which, the petitioner abused them with filthy language and assaulted the defacto complainant with beer bottle and caused injuries to him and also threatened him with dire consequence. Hence the de-facto complainant made a complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that due to previous enmity, a false complaint has been given against the petitioner. Hence, the learned counsel has prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent would submit that it is case where the petitioner had caused injuries to the defacto

complainant. He further submitted that there are nine previous cases pending against the petitioner and there is no change of circumstance for grant of anticipatory bail. Hence, he seeks dismissal of the petition.

5. Heard the learned counsel on both sides and perused the entire materials available on record including the First Information Report.

Taking into consideration the allegations and the bad antecedent of the petitioner and also there is no change of circumstance and that the custodial interrogation of the petitioner is essential, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 31.07.2023 raa
