The petitioner prays to issue to issue a Writ of Certiorari, calling for records relating to the impugned order of the 2nd respondent in his letter No.16448/BPE/2008 dated 17.04.2008 and quash the same as violative of Article 14 of the Constitution of India.

2.When the matter is listed today the learned counsel for the petitioner made a submission that the matter has become Infructuous and he has also made an endorsement to the effect: "This writ petition has become infructuous, hence I may be permitted to withdraw the above writ petition."

3. In view of the above statement and endorsement made by the learned counsel for the petitioner, this Writ Petition is dismissed as having become infructuous. No costs.
