ORDER

This writ petition has been filed for direction to the respondents to take action on the complaint lodged by the petitioner.

2. The case of the petitioner is that the respondents operated bus service in Tiruvallur Region and thereby overcharging from passengers against the bus fares specified in the fare revision order in G.O.Ms.No.48, dated 28.01.2018. The said bus fare revised with effect from 29.01.2018. However, they are charging more charges it is violation of G.O.Ms.No.48, dated 28.01.2018. Though, the petitioner lodged complaint.

3. On perusal of the records revealed that the petitioner himself travel in the bus he was charged more than the bus fare fixed in G.O.Ms.No.48, dated 28.01.2018. However, he failed to specify before this Court from which stage to which stage the petitioner issued with high fare 2/4

tickets. That apart, there is any discrepancies in the service providers, the petitioner ought to have approach the consumer forum. In fact, the petitioner approached the consumer forum, his grievance was rejected by the consumer forum.

4. Therefore, the representation submitted by the petitioner cannot be considered in this writ petition that too under article 226 of Constitution of India. Since this matter is to be decided only by way of trial. Therefore, the direction sought for in this writ petition cannot be granted.

5. Therefore, this writ petition is devoid of merits and liable to be dismissed. Accordingly, this writ petition is dismissed. No costs. 16.04.2024 Index : Yes/No Speaking/Non-Speaking order gvn G.K.ILANTHIRAIYAN,J.
