ORDER

This Writ Petition has been filed seeking to forbear the respondents herein from diverting the course of existing PAP canal which runs through S. No 154 / 1A1 and 154/1B to the petitioner lands at S. No 233/1 and 233/2 and consequently maintain the flow of water only in the existing PAP canal.

2. The learned counsel for the petitioner would submit that the subject property belongs to the petitioner. As the respondents are taking steps to divert PAP canal to his land by completing diverting the course of the PAP Canal and again linking the same to the existing channel by taking 'U' turn, the petitioner has given a representation dated 16.03.2023 to the respondent objecting the diversion of PAP canal. As the same did not evoke any response, the petitioner has come forward with the writ petition seeking of the aforesaid relief.

3. In reply, the learned Additional Government Pleader appearing for the respondents would submit that the petitioner's representation dated 16.03.2023 will be disposed of by the 1st respondent within a period of twelve weeks.

4. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents 1 to 4 and also perused the materials available on record.

5. In view of the above, this Court directs the 1st respondent to consider the petitioner's representation dated 16.03.2023 on its own merits and dispose of the same in accordance with law within a period of four weeks from the date of receipt of copy of this order, after issuing notice to the petitioner and after hearing the petitioner as well as the persons concerned and communicate the decision taken to the petitioner.

6. With the above directions, this writ petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed. 30-03-2026 Index: Yes/No Speaking/Non-speaking order arr
