The petitioner has filed this petition seeking for a writ of Mandamus, directing the respondents 1 and 2 to grant the benefit of Government Scheme framed under Proceedings No.191, dated 20.10.2018 in accordance with G.O.(Ms.)No.222, Finance (Pension) Department, dated 30.06.2018 to ensure reimbursement of the medical expenses incurred by the members of the petitioner Society and pass orders.

Heard Mr.V.Anand, learned counsel for the petitioner, Mr.K.Rajkumar, learned Standing Counsel for the respondents 1 and 2 and perused the materials available on record.

Mr.V.Anand, learned counsel for the petitioner submitted that the members of the petitioner Society are retired pensioners and they are subscribing to the Health Fund Scheme and their subscription is being deducted from their monthly pension. The very object of subscribing to the Scheme is to ensure that the retired employees are given with medical benefits and hence they can reimburse the expenses incurred by them towards their medical treatment. He further submitted that nearly 159 persons had made similar claims and they are waiting for the orders from the respondents.

Mr.K.Rajkumar, learned Standing Counsel for the respondents 1 and 2 submitted that this petition has been filed by the petitioner Society even though each of its members have got different cause of action and different claim. It is further submitted that the respondents would consider 3/6

the claim of the petitioner Society if individual representation is made by each.

Though it is understandable that each member of the petitioner Society would be having distinct and different claim, the petitioner has come out with a common grievance that none of the medical bills have been taken up for reimbursement even though there is a Scheme for which the petitioner is making the contribution.

Since the very object of the Scheme is getting defeated and timely consideration is not given to the medical claims made by the retired pensioners, I feel it is appropriate to direct the petitioner's Society to submit individual representation of its members to the respondents 1 and 2 within a period of two weeks from the date of receipt of a copy of this order. On receipt of the same, the respondents 1 and 2 shall consider the same in accordance with the norms existed / existing and pass appropriate orders within a period of four (4) weeks from the date of receipt of the representation of the members of the petitioner Society. 4/6
