ORDER

The petitioner, who was arrested and remanded to judicial custody on 08.04.2025 for the offence punishable under Sections 331(2), 305, 62 and 64(2)(1) of BNS, in connection with Crime No.8 of 2025, registered on the file of the respondent, seeks bail.

2.The prosecution alleges that on 05.04.2024, the petitioner broke into the defacto complainant's house, threatened her for money, and then sexually exploited her. Hence, the case.

3.Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner was arrested and is in judicial custody from 08.04.2025 and ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner. 4.Learned Government Advocate (Crl.Side) appearing for the respondent

police reiterated the prosecution case and submitted that the victim is 80 years old and subsequent to the occurrence she was mentally and physically affected and admitted in hospital and she lost her breath. He would further submitted that the petitioner has two previous cases and hence, he opposed for grant of bail to the petitioner.

5. Considering the gravity of the offence committed by the petitioner, his bad antecedents and also the period of custody, this Court is not inclined to grant bail to the petitioner.
