This Criminal Original Petition has been filed by the petitioner/A3, who was arrested and remanded to judicial custody on 11.06.2024, seeking bail in Crime No.311 of 2024 registered for the offence under Sections 341, 294(b), 323, 397 & 506(ii) of IPC.

2. Learned counsel appearing for the petitioner submitted that this is the second application for bail filed by the the petitioner before this Court. He further submitted that the co-accused has been released on bail and the petitioner, who is no way connected with the alleged offence, has been suffering incarceration from 11.06.2024. Hence, he sought for bail stating that, he is ready to abide by any stringent conditions that may be imposed by this Court.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police submitted that, the petitioner/A3, who is a habitual offender having 32 previous cases, along with two other accused waylaid the de facto complainant, abused him in filthy language and robbed a sum of Rs.800/- from him at knife point and threatened him with dire consequences. He further submitted that the earlier bail application filed by the petitioner was dismissed only on 11.07.2024 and there is no change in circumstances. Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either sides that the investigation is still pending and there is no change in circumstances and also considering the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
