PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the first respondent to remove statue or memorial established by the respondents 6 and 7 which remains as obstruct the entry of the petitioners' patta lands and to prevent the respondents 6 and 7 from erecting a statute and memorial in front of the petitioner's residence and vacant site at Kattinayanapalli Village and Post, Krishnagiri Taluk and District.

O R D E R

This Writ Petition has been filed to direct the first respondent to remove statue or memorial established by the respondents 6 and 7 which is obstructing the entry of the petitioners' patta lands and to prevent the respondents 6 and 7 from erecting a statute and memorial in front of the petitioner's residence and vacant site at Kattinayanapalli Village, Krishnagiri Taluk and District.

The learned counsel appearing for the petitioner submits that adjacent to the petitioners' property, there was a vacant land, in which, the local politicians already erected Indira Gandhi Statue and small memorial of Rajiv Gandhi on the highways without any permission from the Highways Authority. Now, the respondents 6 and 7 have removed the statue and memorial and put up the same in front of the petitioners' house. In fact, the State Government has issued the guidelines for installation of Statute in public property vide letter dated 26.03.2019. Without following the guidelines issued by the State Government, the said Statute and memorial was erected by the private respondents in the public property which is not sustainable one. Hence, he prays for appropriate orders.

3. The learned counsel appearing for the respondents 6 and 7 submits that statue was erected in the year 1987 prior to the letter dated 26.03.2019 and at the time of erecting the statue, the private respondents obtained necessary permission from the Local Body and therefore, if at all erection is

done in the public road, it is for the stakeholders to take action for removal of erection and the petitioner is not an aggrieved person.

4. Recording the submission made by the learned counsel appearing for the respondents 6 and 7, this Writ Petition is dismissed. There shall be no order as to costs.
