This Criminal Original Petition has been filed to quash the proceedings in STC No.2360 of 2022 on the file of the Judicial Magistrate No.VI, Coimbatore.

The learned Additional Advocate General appearing for the respondent submitted that the trial has already been commenced pursuant to the directions issued by the Hon'ble Division Bench of this Court in W.A.Nos.2085 and 2086 of 2022 dated 10.11.2022. In compliance with the said directions, the trial has been commenced and the prosecution has so far examined P.Ws.1 and 2. However, the petitioner did not cross examine the prosecution witnesses. 2/4

In view of the above, the entire proceedings cannot be challenged, since the trial has already been commenced and the prosecution has so far examined P.Ws. 1 and 2. Hence, this Criminal Original Petition stands dismissed. However, the personal appearance of the petitioner is dispensed with before the Trial Court. The Trial Court is directed to complete the trial within a period of six months from the date of receipt of a copy of this order.
