This miscellaneous petition has been filed to condone the delay of 85 days in preferring the above appeal against the judgment dated 23.12.2021 in Spl.S.C.No.10 of 2020, on the file of the Special Court under POCSO Act, Nagapattinam.

2. The petitioner was convicted for the offences under Sections 10 r/w 9(m), 12 r/w 11(i), (iv) of POCSO Act and 506 (ii) IPC, and sentenced him to undergo rigorous imprisonment for 7 years and to pay a fine of Rs.10,000/- in default, to undergo simple imprisonment for one year for the offence under Section 10 r/w 9 (m) of POCSO Act; and sentenced him to undergo rigorous imprisonment for three years and to pay a fine of Rs.5,000/- in default to undergo simple imprisonment for a period of six months for the offence under Section 12 r/w 11 (i), (iv) of POCSO Act; and sentenced him to undergo rigorous imprisonment for 7 years for the offence under Section 506 (ii) of IPC. Challenging the said judgment, the petitioner has filed the present petition to condone the delay of 85 days in preferring the appeal. https://www.mhc.tn.gov.in/judis

3. Heard the learned counsel for the petitioner and perused the materials available on record.

4. Considering the reasons stated in the affidavit filed in support of this petition, more particularly that the petitioner has been in incarceration pursuant to the conviction and sentence ordered by the learned Special Judge in Spl.S.C.No.10 of 2020, the delay of 85 days in preferring the appeal is condoned.

5. The Registry is directed to number the Criminal Appeal, if it is otherwise in order.
