Prayer: Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the first and second respondents not to vacate the petitioner from the premises bearing T.S.No.4/2 and 4/3, Survey No.1289/1, 1293/1, Endathur Road, Iyyanarappan Koil Street, Madhuranthagam-603 306 except due process of law.

ORDER

(Order of the court was made by the Hon'ble Chief Justice) We have heard Mr.P.G.Perumal Pandian, learned counsel for the petitioner; Mrs.R.Anitha, learned Special Government Pleader for the first respondent; and, Mr.R.Muniyapparaj, learned Additional Public Prosecutor, assisted by Mr.M.Sylvester John, learned counsel for respondents 2 and 3.

2. The petitioner claims to be a tenant under respondent No.4. The proceedings are deemed to have been initiated against respondent No.4 for the offences punishable under the India Penal Code. The property is attached pursuant to the Criminal Law (Amendment) Ordinance, 1944.

3. The procedure is prescribed for an aggrieved party in the Criminal Law (Amendment) Ordinance, 1944 itself. The petitioner may avail the remedy that may be permissible under law. In that event, all contentions are kept open.

4. With these observations, the writ petition is disposed. There will be no order as to costs.
