ORDER
This writ petition has been filed seeking to quash the order passed by the 1st respondent in his proceedings Na.Ka.No.2166/2019-SaPa-E.P.No.12/20192020 dated 03.06.2026.
2. The brief case of the petitioner is that the petitioner has been served as a Secretary of the 3rd respondent Society and during the period 2004 - 2009, loans were sanctioned to some of its members by the Board of Directors and Special Officers. Subsequently, alleging irregularities in the sanction and disbursement of the said loans, an enquiry under Section 81 of the Tamil Nadu Cooperative Societies Act was conducted and reports have been submitted. Accordingly, the 1st respondent passed an order dated 24.12.2018, fixing liability upon the petitioner for unrecovered loan amounts and initiated Surcharge Proceedings against him. Against which, CMA was filed before the District Court and the same was dismissed. Thereafter the petitioner approached this Court by filing Civil Revision Petition in CRP No.2118 of 2023 which was allowed on 22.
10.2024, setting aside the order passed by the District Judge and remanded the matter back to the District Judge. However, the District Judge having reconsidered pursuant to the remand of the CRP, passed orders confirming the Surcharge orders. Hence, this Writ Petition.
3. Heard the learned counsel for the petitioner and the learned counsel appearing for the respondents and perused the materials on record.
4. The grievance of the petitioner is that pursuant to the confirmation of the Surcharge order by the District Judge and filing of CRP before this Court, attachment order came to be passed which is impugned in this writ petition. However, the petitioner cannot seek such relief by way of filing a writ petition and must instead file a Civil Revision Petition.
5. In view of the above, this Writ Petition stands disposed of granting liberty to the petitioner to file Civil Revision Petition along with appropriate interim application, seeking stay of the attachment proceedings.
