Heard Mr.K.Govi Ganesan, learned counsel for the petitioner and Mr.A.Edwin Prabakar, learned State Government Pleader for the second respondent. None appeared for the first respondent.

This petition is filed seeking leave to file the appeal. The petitioner contended that without arraying the petitioner as a party to the writ petition, the impugned order has been obtained by the first respondent to survey the lands. In fact, the first respondent included the petitioner's property also in the writ petition. The impugned order adversely affects the rights of the petitioner herein.

Satisfied with the reasons stated in the accompanying affidavit, this petition is allowed and the petitioner is granted leave to file appeal.

The Registry is directed to number the appeal, if it is otherwise found to be in order.
