The petitioner is facing prosecution in C.C.No.10284 of 2014 before the learned Chief Metropolitan Magistrate, Egmore, Chennai for offences under Sections 406 and 420 r/w 34 of IPC. It is seen that the petitioner was arrested on 23.05.2011 and remanded to judicial custody and thereafter, he was released on bail. After the final report was filed, the petitioner was appearing before the trial court regularly. On 10.03.2016, he did not appear in court on account of which a non bailable warrant was issued against him and the same is pending for execution. Therefore, the petitioner has come up with the present petition for a direction to recall the warrant.

2. The petitioner is directed to surrender before the learned Chief Metropolitan Magistrate, Egmore, Chennai , on or before 24.10.2016 and file application for recall of non bailable warrant. On such application being filed, the same shall be considered by the learned Chief Metropolitan Magistrate, on merits on the same day. If the petitioner absconds further, a fresh FIR can be registered against him under Section 229-A of IPC.

3. In the result, this criminal original petition is disposed of with the above directions.
