The wife is the petitioner. She married the respondent on 13.06.2022 at Ambattur, Chennai. From the wedlock, a baby girl was born on 18.10.2023. The child is about an year old. Due to disputes and differences, the husband and wife have separated. The husband, though working in Siruseri, has initiated proceedings in his native place at Puducherry and he has sought for divorce on the ground of cruelty in M.O.P.No.303 of 2024. The petitioner pleads that she is not supported financially by the husband. She also pleads that she is unable to travel from Chennai to Puducherry to attend the hearings.
2. Taking into consideration the financial as well as physical difficulties expressed by the wife, I am inclined to allow this transfer petition. Hence, the proceedings in M.O.P.No.303 of 2024 is withdrawn from the file of the Family Court at Pondicherry and transferred to the file of the Family Court, Chennai.
3. The Family Court at Chennai will not insist on the appearance of 2/4
the husband for every hearing. He shall, however, appear when his appearance is essential or when so directed by the Family Court. On the other hearings, he may be represented through a counsel.
4. Accordingly, the Transfer Civil Miscellaneous Petition stands allowed. No costs. Consequently, connected civil miscellaneous petition is closed.
