This petition is filed to condone the delay of 53 days in filing the above appeal.

2.Since the first respondent remained ex parte before the Tribunal, notice to the first respondent is dispensed with.

3.Mr.P.Suresh Srinivasan, the learned counsel entered appearance for the second respondent.

4.Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed. 5.The Registry is directed to print the name of the learned counsel for the second respondent in the cause list when the matter is listed for admission, and number the above C.M.A.SR.No.94751 of 2023, if the papers are otherwise in order.

Anu 6.It is underscored that in the eventuality of the appellant succeeding in the appeal to be taken on record, he would not be entitled to any interest for 53 days.
